Legalization of marriage

Most Egyptians are charmed by foreign women, not only the looks, also especially the money. A lot of negative remarks are made, and we all know this: the bezness relationship. However, love not let pressure us. Stay from 2 genders in a hotel or resort is not allowed, and most apartments require at least a orfi contract. Signing an orfi contract is serious, however validity is mostly not enough, and can be torn apart after the holiday. But realize that an Orfi Contract is recognized by Islam. The orfi contract gives the partners no legal rights, but emotional value is high.

The orfi contract which can be purchased from a lawyer. It needs 2 witnesses and is a very loose "contract" of marriage and not considered official or "real". Even this contract is not a guarantee that all hotels or flat owners will allow you to stay. An Orfi marriage as it is defined and practiced in Egypt means a man and a woman (in many cases an Egyptian man and a foreign woman) simply agree to be married, neither giving or receiving legal rights. Note also that by Islamic Law, men can marry 4 wives. A woman has no right to have another man, even in case of legal divorce. Egypt is a family minded country, where wives, certainly when there are children, not can remarry by their families.

What inquiries to make an orfi contract?

  • Proof of identity (a passport) for both parties 

  • Photocopy of the passport data page

  • Egyptian entry visa and the residency stamp if you obtained one 

  • Five personal photos for each party

  • Two male witnesses with identification, or for each male 2 females

What requires a legalized marriage?

In short: marriage for foreigners in Egypt is a civil ceremony performed at the local marriage court, which is in accordance with Islamic practice. Persons wishing a religious ceremony may arrange for one separately, but it is the civil ceremony that establishes the legal marriage. In fact all lawyers can make orfi contracts. How an Egyptian marriage work?

A Muslim marriage gives a wife the unconditional right to economic support from her husband regardless of her own financial resources. She also remains in control of her property, including inheritance or earned income. However, in case of divorce, the ex-wife is only entitled to three months' alimony and to those possessions that she brought with her at the beginning of her marriage or those that she acquired with her own income, as well as any portion of her mahr that is due her. Mahr is a sum of money or durable property that, according to Islamic practice, a husband agrees to pay to his bride at any time prior to or during the marriage or upon divorce.In return for the unconditional economic support of his family, a husband has certain rights within the marriage, the most important of which is the right to restrict his wife's physical mobility, which is often interpreted as the right of a husband to prevent his wife from working outside the home. He also has the unilateral right to end the marriage without the consent of his wife. And in case of divorce, the husband legally receives custody of the children after they have reached the age of seven. It is, however, customary for girls to remain with their mothers after a divorce. Recently, changes in the law in favor of women have curtailed some of husbands' rights. Primarily, women are now able to file for divorce, especially in cases of domestic violence, and men must now legally file for divorce and cannot divorce a woman simply by uttering "I divorce thee" three times, as is permitted by the Qur'an. Cultural practices, such as cross-cousin marriages and sizable sums of money through the mahr, have evolved to protect women and counterbalance the unequal rights in cases of divorce. However, the relatively low incidence of divorce in Egypt (according to the last census at 2%), particularly after children are born, suggests that marriage is a stable institution.

Note from our European female Lawyer: Although man can marry 4 times, mostly there is not enough money. In present days the new wife will live in their second home. In fact, the first marriage is a family arrangement and official divorce gives lot of problems. So the man stay officially married, fulfill his financial duties, and start with you a new life. The idea that all women share one house, can happen in traditional Egyptian families, when the wives also agree (the man can obey her to accept). In Bedouin culture, this can be even more then 4 wives. Anyway, however your man is not officially divorced, he love you, and threat you the same as the European husbands.
